Terms of Service
I would love to create work for you! By commissioning me, you are agreeing to the following terms. Please read them carefully, so there are no misunderstandings.
General Terms
- Please provide images for reference. I cannot work from descriptions alone.
- If you are commissioning art of someone else’s original character, please make sure you have their permission first.
- I like making fan art, but fan art comes with legal complications. If you wish to commission fan art, please DM me (Twitter @puffbird, Tumblr ask @puffbirdstudio, Discord puffbird#4040) with details before submitting your request, so I can tell you whether or not it’s something I’m willing to do.
- I will do my best to communicate my progress in a timely and consistent manner, with regular check-ins, but life happens. Keeping in contact with me about the status of your commission is encouraged, as long as it’s within reason! Checking in once a week is fine. Contacting me three times a day is too much — and responding to your messages eats into the time I have for working on art.
- I reserve the right to refuse any commission for any reason, including but not limited to: my ability to complete the commission, the content of the commission, the behavior of the commissioner, etc.
- The commissioner will receive a digital .jpg file, unless negotiated otherwise.
- Things I WILL draw: original characters, anthros, humans, animals, monsters, landscapes
- Things I WILL NOT draw: architecture, vehicles, kissing, NSFW anything
Payment and Refunds:
- All prices are listed in USD, and payment is taken through PayPal invoice. Requests for alternative forms of payment (Venmo, cash apps other than PayPal, cryptocurrency) will not be accepted. (PayPal invoice allows you to pay by credit card; no PayPal account necessary!)
- Do not send payment before I accept the commission. Wait for me to send an invoice!
- 50% payment is required up front, and 50% on approval of the sketch.
- Please make sure you have the money to pay before you commission me! Delaying the queue when you can’t pay is unfair to other commissioners.
- Payment is nonrefundable. If you wish to cancel the commission at any time and for whatever reason, whatever money you sent as of that moment will not be returned. (For example, if you want to cancel after you’ve received the sketch, the upfront 50% covered the time preparing the sketch and making alterations for you. I will not charge the other 50%, but I will also not finish the cancelled commission.)
- Additional characters will cost extra.
- Complex characters will cost extra. (fancy costumes, extra accessories, etc.)
- Changes to the sketch are free until you have approved the sketch. Once you have approved the sketch, there are no more free revisions to the sketch. If you decide to make further alterations to the drawing, there will be an additional fee. Please be sure you’re confident in the sketch before approving.
- Immediate color changes are free. If you would like more color changes at a later date, there is a fee.
- If you would like to use the commission on merchandise for re-sale, there’s an additional fee per design.
Non-negotiable:
- You may use commissioned art for personal use — icons, prints, etc. — as long as you’re not reselling it for profit. You may post commissioned artwork with credits to Puffbird Studio on social media.
- You MAY NOT turn my art nor any portion of it, cropped or otherwise, into an NFT (non-fungible token).
- Standard commissioned works may not be reproduced, resold, or used for profit in any shape or form, including as illustrations in books for resale.
- If you wish to commission work for commercial use (illustration, merchandise, etc.), I charge an additional licensing fee either upfront or in the form of royalties. Please contact me directly to negotiate.
- I, the artist, retain the right to post finished work in my portfolio and/or on social media in a lower quality format and size, with credit to the commissioner.
